Position of the police

Respected Sir/Madam, Kindly clarify whether position of the Police can be mentioned as a part of the Hon'ble Judiciary by any angle or aspect?

Hi there!

It is a well established notion that the Government has three branches, namely:

1. The Legislature (makes the laws)

2. The Executive (Ensures implementation of laws)

3. the Judiciary (interprets the laws)

The Police force is an instrument for the prevention and detection of crime (as stated in the Preamble of The Police Act , 1861). Every State Government establishes its own police force which is formally enrolled. The Police is a part of the criminal justice system, along with Courts and Corrections, but it is not a part of the judiciary. As the police is responsible for effective implementation of laws and prevention of crimes (breaking of laws), it is a part of Executive Branch of the Government.
