Normally, in any Employment advertisements, the upper age limit as at a specified date shall be specified. If the Candidate is within the upper age limit as on the date specified in the Advertisement, he is eligible to be considered for employment, if selected. The selection process may take sometime and by the time the Candidate is, in fact, selected for Employment, he might have crossed the upper age limit noted in the advertisement some time ago. Therefore, the criteria in the case as explained by you is the age as on the date specified in the advertisement and whether the candidate is within the upper age limit.
