Passport police verification- pending case

Dear Experts,

I have applied for reissue passport, subject to police verification. In this CCTNS report on my name there is a case pending which is related to my brother suited by his wife. Detailed as False acquisition on my name and including all my family members as dowry/women harassment.

And for the same Quash petition has been filed to High court and issued Interim stay around 2019. It is been 4 years as of now, but case pending as NTF.

Will I get passport??

When a case is pending, it is not possible.

Is it criminal case or civil case.

The police station concerned will report it in the verification means you will be refused passport.

The case Section is IPC-4TNPHW act@417,498(A),506(1). Cases FIR is been filed.

Adjoining all my family members the above care has been registered. But at that time of compliant and FIR has been registered I was outside of India.

Please let me know the procedures

Thank you for your query! I am Aadil and I will try to answer your question.

The short answer to your query is NO. It won’t be possible to get a passport.

Since the case is a criminal case that is pending as of now, it is not possible to get a passport issued. The Passports Act of 1967 clearly specifies in its Section 6(2) that the Passports Authority may refuse to issue a passport to an applicant if there is a criminal case pending on him. Section 6(2)(f) specifically mentions this, stating that if the proceedings in a case where the applicant has been alleged to have committed an offence is pending in a Criminal Court in India, the Passports Authority may refuse to issue the passport. This is done to ensure the presence of the applicant within the country until the Court proceedings are completed and to prevent them from fleeing the country to escape punishment.

Therefore the Passport Authority will most probably refuse to issue the new passport.
