Cost imposed for niacl jugglery

Thanks for posting.

It is good that HC has taken a note and has awarded penalty to offender and thus reprieve and relief to public.

This decision of HC shall encourage many amongst the public and their lawyers to expose the "jugglery of legal provision" played by NIACL and other establishments.

Such decisions by learned Courts shall be a step towards reducing the legal burden caused by establishments.

PSU should not indulge in legal jugglery: HC May 5, 2008 | PTI NEW DELHI: Holding that indulging in "jugglery of legal provision" for depriving the public of its due is an abuse of law, the Delhi High Court has imposed a cost on NIACL for resorting to such practice. Justice V B Gupta said the government undertaking should have a sympathetic view towards the general public. "The government undertaking must have human approach and should not indulge in the jugglery of legal provisions as to deprive the unfortunate victims of their legal due," Justice Gupta said while imposing a cost of Rs 5,000 on New India Assurance Co. Ltd (NIACL)
