Criticize government

There are few government employees who created a WhatsApp group unofficially consisting of 150 people, as a support to one union. In the group discussion/debate few members criticized the government on this pandemic virus, for not taking proper steps, etc. Does it a violation of any law, will it become an issue. If so, when/how will it become an issue? If it has become an issue, how can we fight this case?

While one appreciates the varied interests of the student, there are other ways of finding the latest judgments, workshop reports, etc that can be accessed by a student, instead of waiting for a spoon feeding answers on academic queries.  It is up to you to consider this forum is meant for academic queries or fo helping a common man or those facing a complication in litigations.

Article 19 gives all citizens the right to freedom of speech and expression but subject to "reasonable restrictions" for preserving inter alia "public order, decency or morality".

India prohibits hate speech by several sections of the Indian Penal Code, the Code of Criminal Procedure, and by other laws which put limitations on the freedom of expression. Section 95 of the Code of Criminal Procedure gives the government the right to declare certain publications “forfeited” if the “publication ... appears to the State Government to contain any matter the publication of which is punishable under Section 124A or Section 153A or Section 153B or Section 292 or Section 293 or Section 295A of the Indian Penal Code

As per your query, let me tell you that On 7th December, 2020 a Bench of Justices AM Khanwilkar and Sanjiv Khanna of Apex Court (SUPREME COURT OF INDIA) held in no uncertain terms that disloyalty to the government by law and comments was not an offence if did not call for violence and public disorder.

So the WhatsApp group you're talking in your query, anything that you say there against the government would not tend to violate any law if it hasn't led to create any violence or disorder amongst the public.

Mr. Prasad, I do respect the purpose of LCI and appreciate this platform and the experts who are always ready to help. 

These queries have been collected from the needy participants and posted on the forums to get back to them with answers. 

Many of them do not know how to use forums and seek the right answers. 

I am really sorry if this has in anyway degraded the platform or annoyed the experts.

This is the version filed by a first-year law student: There are few government employees who created a WhatsApp group unofficially consisting of 150 people, as a support to one union. In the group, discussion/debate few members criticized the government on this pandemic virus, for not taking proper steps, etc and first-year law student adds that These queries have been collected from the needy participants and posted on the forums to get back to them with answers. 


If the first-year law student was approached by a group of 150Govt. Employees in support of one union and sought their rights to criticize the Government when the pandemic is a universal problem,   I do not wish to comment on this burning issue. and can express sorry for that group for not knowing their duties vis vis rights as laid down in their own rules and regulations.

I can only hearty appreciate the first-year law student for her vast connections and relations for raising the following queries when approached by persons..
