Hello:
Mr John has filed a Cheque Bounce Case and also a Recovery Suit on the same amount against the same party. The Criminal Case has been pending for judgement for the last 6 months. Mr. John has fallen ill now, the Judge in the Recovery Case asked family member daughter Ms Mary to take Power of Attorney and continue the proceedings.
My question is,
1. Can the defendents lawyer use the Oral Cross Examination of Mr. John in the Cheque Bounce Case and bring it in the Civil Recovery Suit ?
2. Can the Defense produce Certified Copies of Mr. John's Cross Examination done in Criminal Case as Evidence in Civil Recovery Suit ?
