Hello,
Though it is according to the courts to decide what falls under the definition of cruetly against the husband, in most of the cases, misuse of laws are a major reason for the same.
Some of the cases that can fall under cruelty against husband are:
- Misuse of dowry laws, Domestic Violence Act and Sec 498A IPC.
-Wife threatening to leave maternal home and to commit suicide.
-Mental cruelty
-Verbal abuse
-Deserting the spouse
-Initiating criminal proceedings with malafide intention against husband and in-laws.
-Extortion of money
In Mrs. Deepalakshmi Saehia Zingade v/s Sachi Rameshrao Zingade (AIR 2010 Bom 16), it was held that the wife filed a false case against her husband on the ground of ‘Husband Having Girl Friend’ which was proved as a false allegation in the court of law and therefore it amounted to cruelty against husband.
Similarly in, Anil Bharadwaj v Nimlesh Bharadwaj (AIR 1987 Del 111), it was helf wife who refuses to have s*xual intercourse with the husband without giving any reason was a sufficient ground which amounts to cruelty against husband.
