If an importer pays vessel demurrage charges to foreign parties in foreign currency for delay in ship berthing at sea port in India due to congestion etc, whether this demurrage charge is includible in assessable value for the purpose of customs duty. I heard about Supreme Court judgement. Please enlighten me.
