Daughter right on property

my father died this year.....we are 2 sisters & 1 brother.....most of my fathers' property are in name of my father or mother or joint.....now my mother who want to transfer all the property in her name or brother who is minor now....she doesnot want to give any money or property to us as we are girls....she tells us every now & then to move out of our fathers' property.....she already sold one of the property which was in my fathers name....without our consent or signature.......i just want to know whether its legal or not.....

on a father's property, all legal heirs have a right...Even a daughter...

 

I feel sad for u that you have to stand against ur mother and claim ur share..But in today's world, nothing is predictable and u can claim ur share but u shud be ready to bear legal expenses...

 

Above all legal heirs i.e.u , ur sisters, brother and mother are supposed to get property share/money share from the property. I hope u have not signed any document in the past where mother has been given attorney to do property transactions pertaining to father or any other similar document.

i do not want to stand against her but i just want to teach her a lesson......The way is behaving it seems that we are nothing & brother is everything....will a legal notice is ok ...

Legal notice is the beginning & it should be with the correct facts coz mere sending of a notice wont suffice....When we send a notice, it implies that we are towards a legal step..Not necessary that ur mother & brother would succumb easily..

 

Hence u need to be sure of what properties she's sold with all the documentary evidence & cash collected by her.....What other properties ur father has & so on...Notice shud be specific...

 

Its not just civil, u can eqully initiate criminal proceedings but through direc guidance of a good lawyer.
