My father and uncle divided their properties through a Learned Civil Court at Panipat through a declaratory decree in 1978. The above decree has not been executed/implemented till date. One of the above properties actually was in the name of my uncle and myself. I was not a party to the above declaratory decree. My uncle transferred the half portion of the said property through a registered relinquished deed to me in 1999.
My father made a Will in 1986 of the above property on the basis of the above decree and gave half of the property to my elder brother and half to myself.
On the basis of the above unexecuted declaratory decree whether my father can make a Will of the property which was owned by my uncle and myself?
