Defamation

How to prove anonymous defamatory typed photocopies of letters, posted to my past colleagues by my spouse. Can I use this information to prove cruelty for my divorce petition?

Sir,

Yes you can on the basis of the facts stated in the letters (stating that those facts could only be known to your wife and her motive as well).

What you will get by proving defamation, except paying fees and roaming courts. So the best use of them lies in divorce petition under cruelty gournds.

My lawyer says that whatever she has posted are photocopies and typed material containing facts pertaining to both of us. So, my wife's lawyer (she herself is a leading lawyer) will easily prove that they have been sent by me to put false allegations upon her. Further, even if we prove that the envelope was written and sent by her, even in that case we cannot prove what were the contents of that envelope. The whole matter would go against us. Furthermore, the matter is about 4 years old.. At that time it did not occur to me to file any FIR or testimony, and I could also not examine any of my colleagues or recipients as witness of those letters or exhibit any such letter in my exhibits, and I closed my examination is closed, now its her turn to be examined.   What to do now ?
