My wife had filed a complaint with labour officer (welfare officer women) for infringement of her legal right of leave provided under Maternity Benefit Act. Labour officer decided in her favour, then employer went to appellate authority which is Labour Commissioner of the state. There also decision was made in her favour. Employer has now moved to high court and has been provided token no but the case number has not been assigned. My wife has applied for sabbatical leave, the provision says that if a court case is pending, she isnt eligible for the same.
Can someone guide whether technically "a court case is pending against her" ?
