You have to see the terms and conditions agreed upon in the sale agreement.  The builders will normally extend their time this way, however, you may issue him a legal notice to either cancel the agreement and return you the amount or to complete the construction within the extended time limit (if you agree for it) after which you can approach appropriate consumer forum for relief and remedy.

well said by expert here..you need to first get things in writing clearly on the completion date or atleast the penalty case  before even considering moving to the consumer court in future..dont rush with consumer court affairs unless you have all facts well prepared.
