Delay in salary payment

I worked in a small BPO organization for almost 2 years. During the last 6 months, Director did not pay me, stating he was hard on cash. I left the organization, with 6 month dues still pending. I asked him for my dues, but he expressed his inability.

Finally, after 1 - 1/2 years, now, he said he was in a position now, and will pay.

Now, according to labor laws, is the director liable to pay me the 6 months salary,
or
6 months salary + interest accrued for the period of delay (1-1/2 yrs)?

So, what amount should I ask him now?

Please suggest.

You first send a legal demand notice demanding the dues to you along with interest till the date of settlement.

If there's no response you may file a suit for recovery of your dues through a civil court.

Did you send demand notice and the company failed to respond/pay the dues? If so, file a claim before Labour Commossioner or suit for recovery through a local prudent lawyer

The Director may not pay the interest. I suggest you take your six months' salary, ask him for interest for the delay, and settle the issue amicably. Otherwise, it will take time if you approach the court.

The employer is liable to pay interest. Of course, appraching a Court of Law could be quite cumbersome.
