You can approach the civil court seeking remaining amount of consideration. Even if the other party pleads illegality or voidness of the transaction he is liable to return the property on return of the consideration you have received.
Please do not rush for quick remedies where issues are complex and both the parties are at fault. May be, once the civil suit is filed, mediation could be opted for and and amicable settlement arrived at.
