Dear lawyers,
Please help me differentiate between Section 299 clause (a) and Section 300 clause firstlty of IPC. Since in both these clauses there is "intention to cause death" how does then these differ?
Regards.
Sir, I went through it. Justice Melvill says "299(a) and 300 (1) show that where there is an intention to kill, the offence is always murder."
Then where lies the difference between the two clauses?
I have gone through most of the leading cases on this point but didn't got the answer. Please help.
the main diff is that in murder there must be knowledge of accused that his act is so inherently dangerous that it must, in all probabiljty cause death. That is the main diff btwn 299& 300 ipc ☺
