i do not really understand your query. if there is misuse of the cheque by the holder, then you should object at the outset when you know that the holder is misusing the cheque. or atleast send a detailed reply when he sends a notice for cheque dishonour. 

if there is a misuse, you should inform the bank immediately. you may also file a cheating case against the holder if there are clear evidences for cheating.
