Disown

Dear friends 

i have question regarding the disown, we are three brother living with my parents in my father self earned house.my brother is also livng with his wife in same house with separate kitchen, and he regularly used abusing language to my parents , my father wants to disown him legally ,my father does not want him to stay with us because of his behaviour, he already publish the disown statement in local newspaper. how can it possible leagally , pleas guide us so we can get rid of this problem.is it possible? and how much time it will take , we already consult many lawyer for the same but everyone told that it will take time may be a year or more..

There is no other way except to file injunction suit restrictim him  and his family to enter the residential premises and get him vacated from the premises.  It takes more than one year.

Since it is the self acquired property of your father, he can an injunction suit against the son restraining him from interfering in the possession and peaceful enjoyment of his property and also for ejecting him from the property, take the help of a local lawyer and file a suit as advised.

Dear Mr Jack, In your case an Injunction suit under Order xxxix rule 1 CPC is advised through a good Advocate of the same field. It will restrain the other party to not interfere with the peaceful possession and enjoyment of  property by your father and other individuals who are residing there under licence from your father; in fact it will be as your father is withdrawing his licence given to his sone to live and enjoy his property with his family.

It is good that you have give a publication in this regard in the local newspaper now it is further advised to you that you (father ) should file a mandatory injunction suit against the ill-behaving son to restrain him from enjoyment of your property and live away from you.
