Dispute

Dear Sir,

My husband purchased one agri land buy his own earning few years back. He has one younger brother. During registration my husband's mother cried and requested my husband to include his brother name. out of good will and because of his mother's tears, he inlcude his brother name during the purchase.

Now his brother is claiming the share in that property. Can you advise your legal opinion.

Your husband's brother becomes owner in that case to the extent of his share specified, if no share is specified then to the extent of half. The fact that he did not contribute any funds is inconsequential and such defence is barred by Benami Prohibition Act, 1988

Hi Sir, 

I have a site(Plot in Bangalore), Its been registered on my name in 2005. Now the land owner is thetening me to selltle the transaction with him, so that now he can give all plots to gether for Joint developement so as he can make crores of rupees. 

I am residing in Hyderabad, incase if wanted to file a case against him, can i file case in Hyderabad court or should I do it in Bangalore itself. 

 

And what is the procudure to file a case against the seller

 

Please help me in this matter.

Even if we prove that his brother was not working during that period and the only income for their family was my husband's earning, still his brother can claim for half share? pls reply. Thanks.
