Division of property

Hi all,

 

I had few queries if any one can helo me.

My grandfather died few years ago.He has not made any will. He has two child my father and a brother of my father. Grandpa had a bunglow of two floor. Now due to family diputes we haven't sorted out the issue. Now we both want to solve this. 

1. How the division can be claimed.

2. Due to family dispute we separated the bunglow with different enterance and all the facilities to each floor. So how can my father claim for one floor of bunglow. And is it possible that we can sell that floor as it is different from other? if yes how?

Please help me guys.

If you are going for amicable family settlement, draw 'Deed of Family Settlement and Partition' and register the same with concerned sub-registrar.  If it is not a settlement, you have to file sit for partition.
