He's right under which law you want to file divorce? 

1. The Hindu Marriage Act,1955.

2. The Special Marriage actr,1954.

3. The Foreign Marriage act,1969

4. The Divorce Act,1869.

5. The Dissolution of the Muslim Marriage Act, 1939, which allow only Muslim women to seek dissolution of their marriage.

6. The Parsi Marriage and Divorce Act,1936

You must first clarify the law under which you want to file divorce? Do you satisfy the conditions for filling divorce petition? Why you want to file divorce petition, what grounds and who advised you to do it ? Who will be representing you in the court, you yourself or an advocate? Where in which part of India you want to file for divorce? Where your spouse presently lives? Will you both be filling for divorce jointly, namely divorce by mutual consent? Or, You will only file for divorce?

You must answer all these questions in details and after that you will be told anything which will be of any help.
