Divorce amendment

hi experts,

1. i filed divorce but my lawer mentioned cruelty act under 12(1) {ia} and no desertion act but the petition has mentioned the facts about desertion also.

2. my wife went upto supreme court in 2013 to transfer to her city in another state.

3. my new lawyer says that there is no ground to amend the divorce petion to include desertion section {ib}.

kindly let me know what options i have to add {ib} and any supreme court judgements available.

Dear Querist

File an amendment application under Order 6 rule 17 of CPC before Family court for add the (ib) in the case, the court have power to allow the petition and allow the amendment too.

hello sir,

my lawyer says the addition of desetion clause maynot be possible now because the case got trasnferred from by my wife thru supreme court from city A of state A to city B of state B. since the original filing was done in city A of state A, it maynot be possible to in city B of state B for adding the desertion clause.

on the basis of these, do we have any provisions or any supreme court judgements? please help me with sugesstions.
