Divorce and maintainance

Hello,

We are married since 5 years having a 3 years baby girl. There is no compatibility with each other with unplacent incidents, quarrels, shoutings etc.... and she is too suspicious.

Finally Wife deserted me and my family for more than 2 years now, all efforts towards reconciliation (including personal, social. legal services etc etc) failed. I could sense that she is no more interested in living together and is happy at her place along with the daughter. Since 2 years im visiting her and the daughter at her place but no possitive response. Im still waiting ...

Now she is ready for MCD and claiming compensation (one time settlement) for herself and daughter.
Im ready to pay for my daugher (monthly) because i fear she will take the kid away from me.
I'm not ready to pay for her because we both are eqally qualified (Masters), came to know that she recently quit her job (working for an MNC).

I'm missing my daughter very badly, can i file for visitation rights?

Please advice, should i file an RCR? How to proceed further.

Dear Uday, parents like you and your spouse are ready to say good bye to each other and to your matrimonial home. But you people do not mindthe future of the child. You may live as single or may re-marry if you granted an order of Divorce. Is it the curse of your child to live without father or mother?. Please rethink. YOU HAVE LEGAL RIGHT FOR DIVORCE AND YOU MAY SUCCEED IN YOUR CASE. BUT I WOULD SUGGEST PROPER COUNSELING TO YOU AND YOUR WIFE. I WISH TO POINT OUT THAT YOU HAVE NOT LEVEALED ANY SERIOUS ALLEGATIONS AGAINST EACH OTHER. pLEASE ONCE AGAIN TRY TO GET PROPER ADVICE FROM QUALIFED MARRIAGE COUSELLORS. GOOD WISHES.

i want to know how to file a mutual petition for divorce, in case of  christain girl and hindu boy.  the marriage is not registered but was performed in church and they have a daughter of 19 years old.  the couple is staying separately for more than 12 years.

File jointly the mcd petition u/s 28 of the special marriage act before the family court of your jurisdiction stating that you have mutual ly agreed that the marriage should be dissolved , you can also make a mou for your divorce.

Dear Uday try to settle the matter amicably, nagotiate with her and try to execute a MOU for MCD in which you can mention all your terms and condition regarding child custody or visitation. feel free to call
