Divorce and rcr proceedings

Sirs,

 

I filed divorce (2008) under Special Marriages Act and it was dismissed last year in October 2014.  Wife had filed RCR petition under Section 27 in The Special Marriage Act, 1954 which went in her favor (filed in 2008).  Now it has been almost a year since the order (order passed in october 2013 for RCR and divorce petition dismissed on same date as both cases were clubbed) has been passed and respondent wife did not go for execution proceedings under RCR.  However in the court under section 125 crpc where she has claimed permanent alimony their lawyer asked whether I will take wife back for which I said no (I am suffering from kidney failure and medical documents have been submitted).  The matter of 125 crpc is yet to be decided.

 

Now my question is, since RCR petition went in her favor, and since 1 year has already passed, and wife has not gone for execution proceedings under RCR,

 

1.  Can I approach the same court for divorce again, as purpose of RCR order has not been served?

2.  What is the meaning of this “Section 27 in The Special Marriage Act, 1954.. Section 7 subsection (ii) that there has been no restitution of conjugal rights as between the parties to the marriage for a period of one year or upwards after the passing of a decree for restitution of conjugal rights in a proceeding to which they were parties. ”

 

What importance would it hold in my case?

 

How can I use it in my favor?

though she got rcr in her favour she or neither the law cant force you to join her based on the rcr decree.now if you havent joined her for a year its only her right to file divorce on you based on fact that restitution havent happened for more than a year after rcr decree

My wife was demanding 50 lacs since the day I filed for divorce, meanwhile IA was awarded and I started paying IA but her demands for 50 lacs one time settlement never came down, I could not afford the same, even now I am ready to give whatever little savings I have to her, but she wants minimum 15 lacs which I cannot give, as I dont have.  

Is there no relief for me?  What to do to get divorce?  Can I file for divorce in the same court ?  Or shall I need to go to High Court asking for divorce?  Please clarify.

Hi,

 

Just want to know any other legal remedy for this situation I am in.  Wife is not willing to approach court for divorce and just appears in 125 crpc case and asks outside of court through her lawyer 15 lacs for settlement.

 

Could learned lawyers guide?

When you are facing kidney failure i could not understand the reason for you to seek divorce? there is somehting behind the scene that you are not sharing.

Our advise to young couples on path of war with each other to seek harmony and sense of love and belonging.The life is too short. The litgations take a good part of it. By chance is it because of high stress and emotional genes that you have that your kidney is in trouble? Just take stress off.

Law too cant keep you together if you guys dont wish.

What happened, why the divorce application got dismissed after almost 8 years after its filing, are not the reasons I am here to discuss with you or anyone else.  Why I got kidney failure, yes doctors owe it to the stress, and this happened over a course of 8 years even though I am a teetotal.  That guess of yours is correct.  False cases, dowry allegations, warrants, non bailabe warrants, police romaing to my house, false DV complaint against me and my old age parents, none of which got proved in court, wife and her lawyer failed to prove any of their allegations and the cases got dismissed last year.  All cases were filed in 2008 itself.

But I am in need of Legal advice, and not encouraging words or poetry.

 

It would make sense if some lawyer would answer my above question.  I am here for legal opinion, not for some doctor advice or words of encouragement.

My lawyer says that we will approach HC for divorce, but says there is no gaurantee that case will get over in 1-2 years time, it might take minimum 6-7  years time in high court.  

 

My questions are,

 

1.  Can I approach district court once again with new divorce application, now that RCR case filed by wife has failed?

2.  She is only listening to her relatives who ask her to ask me 15 lacs in cash which I do not have.

 

I want divorce, how to get it, as I dont see any point in approaching High Court, with these laywers playing with dates, and judges supporting only women, what best can be done?

Since you say most of your incidnts are now already over and she has failed to getyou indicted. Why areyou bothering. She has also not executed RCR. 

So what you want lawyers to advise you?

You can simply apply for divorce decree quoting RCR.

High court wont take up your divorce petition . IOt is matter of trial courts upto sessions level.

I advise that you keep quiet and let her keep waiting for your reaction.She will get fed up and come to negoitiaiton table as she will get desperate to settle down herself. Every battle cant be won and faought in court only. Outside court strategies arealso required.

Even now if you see any row of help try to reconcile with situtaion and both of you can take conselling form some independent person.

Actually you are playing up to her games.
