Divorce petition as first appeal in high court.

two divorce suit filed, one before district judge in 2012 and again before family court in 2017, both were rejected, grounds were cruelty and desertion, Now wife wants to prefer an appeal in HC, whether it is maintainable in HC as first appeal and why it was taken by family court when it was already decided by learned District judge.
