Doctor here : my prescriptttion is being used in a 307 case

Hello, I am an ayurvedic doctor, before six months, a girl came to my clinic with complain of pain in one ear, she had mild inflamation / swelling, being an ayurvedic doctor, i wrote down her complain in my prescripttttion pad / referred her to an ENT.

Now, the girl has filed a case on her husband with dhara 307/ 498 and domestic violence. She has submitted my letter head in which i had referred her to an ENT to court along with prescripttttion from other doctors, she said in her complaint that she was slapped so she had pain in an ear and used my letter as a proof.

Now, she came with a letter from police station, asking me questions about her ear pain and if it could have happened because of slapping, to which i have not replied.

Now, during court proceedings, if the matters comes up, can court call me for my statement, and if so, am i required to be present in court ? The issue is, she has filed the case in Maharastra and I am in gujarat, she visited my clinic before six months when she was living in gujarat with her husband.

You are an Ayurvedic doc, not a allopathy one, you dont even come in the picture in this case.  Referring a patient to ENT [allopathy] is what any one could have done.  I hope you did not prescribe anything for her.

They wont summon you, but if they do, just go and tell what has happened that she only complained of ear ache and you did not know under what context the patient started having pain, and yes the court can summon you also and the ENT doctor too, if the opposite party of the said patient would want to clarify the same with you.

There's no medicines prescribed in the prescriptttion. I had given her a very basic pain killer for pain and reffered to ENT. But no medicines mentioned in the prescriptttion.

 

Also, could hey still summoan me, if she did not have my prescripttion ? And I dont reply to the letter from police station inquiring about her pain.

 

I hope, they wont call me, I have to travel to another state for something I am not involved in.

Counsel the lady that in court the opinion of qualified ENT surgeon alone would count and the referral by you is of no use to her...... You may also indicate that you do not think that there was any Samaritan due to hit......and may state so in court and that would be of course of no use to her.. This may deter her and she may not include you.....
