Documents from small causes court

Dear Experts,

Could someone please advice me as to where I should go to collect origingal property documents that were deposited in the small causes court mumbai?

My father was involved in some litgation and the small causes court mumbai had asked him to deposit the original property documents related to the disputed place. Now the case has been settled many many years back in 1994, but I believe that my father did not collect the original property documents back from the court.

Could some one advice me as to whom to contact and where do I go to check if the documents are still there? How long are the documents kept till? This case was in the Small causes court in Fort Mumbai

Make some efforts individually.  First visit the court, and  get a certified copy with the help of an advocate by giving him vakalat as Third party.  When once it is confirmed, take his advice and for return of the documents, as you are not the person and as manylegal heirs may be there to claim and a process may be needed in Court.

But there was a procedure while returning documents before destruction by issuing notice by Courts to collect originals.

However, why did your father did not take back all originals soon after finalisation of the case? What made you to realise this after 21 years?

Most probably the documents of the case must have been destroyed, find it out seeking services of a local lawyer and move application for its withdrawal as per procedure laid down, if available .
