Does sisters have a share who were born before 1961..??

 

hi sir ,

my father has four sister who were born before 1961 and a brother.  we want to sell our garnd pa's property and which is still in the name of my grandpa(who was expired long back) but the problem is  we need a family certificate . we asked them(sisters) but they  are asking about the share . is there any scope that we can get  certificate  or is that certificate compulsory .?? And also are they (sisters) eligible for the share ..?? thanx

when there is no arrangement by your GF in respect of the properties before his death, then after his death all his sons and daughters and his wife are entittle to claim the share as the legal heirs of deceased.

The said property is not self acquired by your father, it is belong to your grandfather so all legal heirs and successors of your grandfather have right over the property.Your aunts( father's sisters) can claim their share,your father can  sell his share only in undivided nature of property.

thanx for the reply but both the grand parents died long back . my dad even gave them other things which my grand mother demanded all the four were born before 1961 . what do you suggest us to do ..??
