Does tenant have right to change nature of property?

Hi,

 

Does a tenant have right to change the nature of property? 

If they have the right, please point me to the acts and/or laws that give tenant such a right?

What kind of changes you are talking about? However, generally speaking a tenant has not right to make any parmanant changes in the property e.g any construction of parmanant nature etc. without the consent of the landlord otherwise this would give the landlord a right to evict him under the rent laws.

Dear Archana,

 

Thanks for the reply.  A portion of the shop is being demolished by municipal authorities for road widening purposes. After the demolition, does the tenant have right to install a shutter in the guise of securing the merchandise.

 

I would appreciate if you can point me to the specific act that prevents a tenant from modifying the property.

Every state has its own Rent Act. There is no single Rent act applicable throughout India. So go through the rent act of the state where the shop is situated or consult any local lawyer for specific details. 

BROADLY SPEAKING I do not think under such circumstances, installing a temporary iron shutter (which can be removed afterwards) would amount to such a change that would give the landlord a right to evict you.
