Domestic violence

i had filed domestic violence case 1.5 years back...... i have applied for dv act under section 12.....sec 18 for protection orders....sec 20 for monetary relief and sec 22 for compensation and sec 19 for residence orders(its for rent accomodation or rent amount) .... my next hearing is in november..... can i file sec 23 in between ???? so that am able to get the court orders for staying in my matrimonial home???? can you please tell will my application be allowed now if i file ??

as of now am waiting for the reliefs....hopefully in november it will be fixed..... so before that can i file sec 23 ?

Dear Shivali ,   What ever you have filed you would have to prove the same in the court of law . your designation you have mentioned is that of a executive and hence it is presumed that you are a working women .If you are being paid a HRA by your company than you want be entitled for rent or rent accomodation as per section 19 of the act .I dont think so under section 20 .....Maintanence you would get any relief with the DV act  as you are working . Maybe provided you have children than you may get some maintanence for the children.

@ stanley..... i was an executive before marriage..... i have never worked after marriage...... am a housewife...... i don't have any children......  do the judges compel to work ?? i mean can the judge direct me to work ?

Nobody can compel u to work. But law does not allow highly qualified + previously working wives to get maint if they prefer to sit idle waiting for money to pour in.

Leave aside law, why u have incapacitated urself not to earn ur livlihood?
