Dowry - 498a

Dear lawyers,

I got married in january 2010. Just after 10 days of marriage i went abroad for work. she spent 7 months in my home with my mother. At the end of august 2010, we celebrated the bangle ceremony in our home and after that she went to her home for delivery and never come back to my home after delivery evenwhile i was in India. In december 2011 i received a notice from her stating that we asked for dowry and threatening her entire family. I have given a reply notice to her that i am ready to face a legal action if any. but she kept quiet after my notice and never come back or speak with us. in august 2012 i filed a divorce case in the court. she never bring any house hold utensils to my home. i have the marriage video evidence for this. she has taken all the jewels in my home including my mothers jewels along with her jewels to her home while she went for delivery. Now she is threatening me that she will ask for all the jewels in the court while hearing. if i ask for the bills of the jewels she will say that its all their family jewels given by her grand mother. so she dont have bills but have the proof of marriage photos. In the marriage she weared only duplicate ornaments taken for rent.

my questions are

1) Could she say in the court that the jewels weared by her in the marriage photographs are gold without providing any bills for the same?

2) will the court accept this statement that all the jewels of her are family jewels?

3) Can she ask for the expenses that her father spent for reception in their city? (entire marriage expenses borne by me)

4) if she says the marriage expenses are borne by them, could i ask for the bills?

5) How can i prove those are duplicate jewels which are weared by her only to show status?

please help me to come out of this problem. I have sufficient proofs for all other false allegations that she made against me.

Even the jewel from her grandmother she shd have bill. The jewel contains certain type of inscriptted code of manufacture, shop details and year of details etc.. on it. It cannot sync with the date of purchase of her grandmother. Only possiblity she should have young grandmother below 40 years, Handy if you have bill from your side..

You can put pressure on her by No 1. You can file an FIR at the local police station and state that the gold from your house is missing while she was at your place . So let the police start the investigation .

No 2. She can say a lot many things in court but she would have to prove that the jewels worn by her are duplicate or gold and  you dont have to prove that  .Just by looking at them nobody  can conclude wether it is real or duplicate .It would have to be tested .

No 3. she would have to prove by way of evidence that her jewels are family jewels and you can always cross examine her as to the source from where they have been purchased ask for the bills etc .

No 4. There is no law as such for her to claim for the expenses of the marriage .
