Dowry case arrest affectring continuation in employment

Mr. X is working in a reputed organization (Factory) and he is now left with few months to retire. He lives in a company provided family quarter (colony) with his family. It was reported that Mr. X along with his family have been harrassing their dauthter-in-law, who was married to his son seven years back, for dowry.  The father of girl made a complained to the police authority and Mr. X was arrested from near the company premises. Subsequently Mr. X got bail and has come to join his duty. He has produced his bail paper issued by the court.

In the light of the above kindly advise on the following points :-

1. Should company need any other document, before he is taken him back on rolls ?

2. In case he is asked to attend to court hearings, should he be allowed unpaid leave, since he has exhausted allhis leave as of now ?

3. I there any other issue, which the company needs to take care of before he is taken on rolls ?

Dear Mr.Jha,

I have been a member/expert with LCI for quite long time. I do not touch matters pertaining to Divorce…………and prefer to post on matters related to labor Law/Service matters……

I would like to congratulate you and applaud you too for posting this query.

Persons with  approach like you to such matters are indeed required in establishments………

You are aware that the law provides for  that the persons accused by  a married woman……………….

Unfortunately some sections of law, legal process and some laws have been misused and as per plethora of publications and judgments too even by the Apex Courts the law enforcement agencies are prompted to exercise due care,caution, restraint before acting to arrest……………………

The aged person (FIL) is due to retire in a few months and has been granted bail by the court of law and is not penalized and punished for any proven offence……………………

 

He should be allowed to live with his dignity and honor that he must have earned in employment with your establishment too…………………and might be having an impeccable record.

He is not proven guilty and hence he should be taken back in employment and let the court of law decide……………….

You can take a stand that courts shall decide on the matter and charges leveled by DIL……and till then he is not guilty.

Moreover you are not court of law!
