Dp act 3

case details:

case:498A and DP ACT 3&4

FIL has a proof of 2.5lac amount send through deposit in my account and in FIR they have said the word dowry clearly.in DVC also they have mentioned this word dowry and paid the amount in bank.

We have sent a legal notice before they are filing 498A and they have replied in the notice that they have given dowry....

now we are all on bails and its more than 5months.....chargesheet is going to be file in few days as my lawyer told me.....

I have sent 2.74lac amount to my FIL for chits in total 10 transactions and want to show to court as i have took money from him for marriage expenses and repaid it..

What is the punishment for dp act 3?
is it a non bailable or bailable ?
will this backfire?
would this be right time for me to file a DP ACT 3 as private complaint in court and req the judge to pass this to PS to file a FIR?
I am going for FIR quash and now its with devision bench in HC...in 10 to 15days it will go to the opposite party..

Dear Rajendra,

First answer us how you got to know that chargesheet is going to be filed in few days. How did your lawyer come to know.

It is fine to put case by DP Act but do realise that it also shows that your accepted dowry and that makes you come under the law and can get the case on you tighter. Its more advisable you focus on FIR Quash. Also you mentioned that quash will go to opposite party. How can your quash go to opposite party?

So take a couple of opinions before you go for dp.

The reply by Mr. Rajaramana is convincing, please answer his doubts.  The court will send a notice t the opposite party to record their objections over your quash petition but what if it has not been granted/quashed?
