DV Act, time to engage counsel

Hi All

Greetings.

My wife has filed false allegations in a DV complaint in a Delhi court and is asking for a huge amount of money.  I just received the summons yesterday and the appearance is tomorrow.  I understand that the first hearing in a DV case is to be within 3 days and the case has to be disposed of in 60 days.

Can I request the honorable judge to give a date in July (as June is vacation time for many lawyers) so that I can find and engage a good lawyer in the meantime?

Also, will interim compensation be granted by the judge, pending my hearing?  She has asked for restraining orders (for me not to contact her) and for money, even though she is employed and is earning 50,000/= p.m.

In your case restraint orders may be passed not to contact her, if her advocate convinces the court that by contact itself amounts to mental or physical cruelty.   Regarding interim monetary compensation, if possible, please take any documentary proof to show that she is earning Rs.50000/- per month.  If the court is convinced that she is not in indigent conditions, she is employed and earning handsome,  the judge will not give interim monetary relief. 

Yes.  You will get adjournment to July or August for filing the reply.

The mandatory period mentioned in the DV Act cannot be practicable due to large pendency of cases.  Any how, in Delhi the DV cases are disposed off quicker than many other parts of the Country.

Thanks for the replies.

I got an adjournment till June 27 which, under the circumstances, is good enough.  No interim orders were passed.

Can you suggest any good, honest, efficient and analytical lawyers in Delhi?
