Summary:This was Muslim Marriage.
Wife was staying with her parents since feb-2012 because she wanted to have seperate residenec in her name and i didn't bow.I divorced her in feb-2013.Then she filed 498a and DV for maintenace and rented property by claiming false incidence.Divorce is accepted and granted before the cases.
Lower courts passed order stating that DVC can not be ruled out as there was domestic relation between us 1 year before so case will proceed.But no maintenance granted or any relief to ex-wife.
Current scienerio:
We have file petition in session court to reject the case as there was no domestic relation + divorce is already done and we also submit proofs that i was in hyderabad with photographs+creditcard statment + my phone bills to show my presence in hyderabad instead of her place in UP.IN lower court my advocate did not show these proofs.
I am in US since Mar-2013.and my father is attending dates.
I am planning to go back india in Jan-14 for vacations and i dont think i'll attend court dates.
498a chargesheet still not submitted and IO assured us that chargesheet will be filled with out arrest as we already given her photocopy of evidences and we already got FIR copy by backdoor.so we are ready to fight on merit.
My Questions:
1.Till now file is not moved to session court from lower court.So when it will move? and who will do this?
2.Will there be parallel dates in lower as well as session?Or case will process in session court only.
My strategy is to drag the case till i am in US for next year than i'll come back and file perjury cases on her based on affidevit filed by her in court stating that i visited her place and beat her black n blue whereas on that i was in hyderbad. and i also have phone recording of complete 13 months from feb-12 to feb-13 where she is accepting that her parents are wrong with phone bills.
I am ready to go in Media also if i get any link.I want to expose my in laws how they destroyed life of her.
