No mere Judgement of DV against her is not enough to dismiss her 24 HMA or 125 crpc.

Maintenance depends on her earning, her expenditures, her liablities, her social status, child custody after marriage and this is vice versa.

Hence, for dismissal of her petition you have to proove that she is elgible to maintain her self if financialy not supported by you.

No..mere resume or interview letter is not gurantee of employment. You have to collect stringent proof of her earning or income or financial backup like and FD's or properties on her name through which she can full fill her needs.

regards.

thank u but when staying with me  as per her statement and in resume she mentioned ctc3 lakh but now she is working or not working i do not have any evidence but in dv i have proved she is mentaly cruel and deserted matrimonial home.some judgement i have seen who js haveing msc mba,pg..etc can capable to maintain themselves sec24 dismissed .

If she has work experience and you have her earlier income details, then better fight on such issues that she is very well capable of earning. Here it the proof which say's that she was earning 3 lac's p.a. The contradictions arise that within a short span how could a person who was earning 25000/- per month, will not earn ahead if she is having educational qualifications which is desribale in open market for job employement. She has willingly drop the job to get salary by husband like a parasite without any responsibilities and conjgalities of married life, put ahead that judgement where her cruelity and desertion been prooved.

Best of luck...
