What would be the advantage if someone doesn't accept the High court summon and not appeared? Seems like in India men doesn't go under mental trauma or being harassed by the girls side.

 

My better half filed a DVA against my mom, brother and me. But we never lived in Joint family after marriage. Almost 1.5yrs stayed separate and in different cities. I filed the Restitution rights in last lived together place and these intelligent  people did not accepted the high court summon and not appeared. 

 

1. How much weight  would this will give to counter my DVA case?

2. What proof shall i provide to file discharge petition for my mom and brother. How much time it will take.

Chandr - first thing first. Get a good lawyer and get his advice to remove the names of your family members (this can be done purely on the records/proofs you show them of their innocence).

Get the docket order from the court you filed RCR and mention it in your DV case counter.
