Elder brother not ready to divide ancestral property

Hello Sir/Madam,

 

My name is Syed, I am from Bangalore.

My query is regarding property dispute.

My grandfather had 2 acres of land; he had 4 children, 3 sons, and 1 daughter.

He died at very young age, after that elder brother of my grandfather took care of 4 children.

When these children’s grown up, my grandfather elder brother transfer the land ( as he was caretaker) on eldest son name.

Now, it is his responsibility of eldest son to divide the land equally among 4, but he is not at all ready to divide

The eldest son is my uncle(my father elder brother), and he is not ready to share the property with my father. “He says land belongs to me, as it is in my name”; he has given the land to my father younger brother, but not to my father.

 

Please kindly let me know, how legally my father can get his ancestral property, also we don't have any documents of the land, all are with my father elder brother.

 

Also, kindly let me know, what the evidences, we need to collect.

You can obtain the copies of the property documents from the revenue department. Ask your father to file a suit for partition against his brother for his share.
