Employment contract

Hi

I received a mid-term salary increment last year in November. The letter that i Did sign said that "It is our understanding that you will stay with us for an year". Does this constitute as as binding contract? There is no other language or implications of breaking the understanding mentioned in the letter. Please help as this is becoming an issue with me switching to a much better opportunity.

Regards

Pls attach copy of the letter signed by you.

What was the laguage of the note printed at the place where you signed.

If you do not have a copy write to HR to provide you a copy.

Apparently the letter is drafted in a manner so as to build a picture that employee has signed a service agreement.

If you come across an increment letter in future be careful to specify that the incrment only mentioned in this letter is accepted by you and retain a copy.It is not mandatory to sign such a letter on the spot.

I have attached the letter while blacking out some parts for maintaining privacy. Please take a look and let me know. From my viewpoint, the letter does not mention a way out or any repurcussions for breaking the understanding. What I need to figure out is that does this constitute a binding agreement?

On one hand the signatory and authority which has signed the letter is thanking the employee for contribution and sustaining the growth

and

on the other hand is declaring the increase in salary is with under standing that employee shall serve the company for 1 year and has asked the employee to sign the acceptance.

For Compnay the contrued meaning is agreement to serve for 1 year.

No damages are expressed in the portion posted by you.

However companies are known to step on the toes on employee and apply tactics e.g. refusal to issue:

acknowledgment of notice of resignation, acceptance of resignation,FNF statement,FNF dues, relieving letter etc and then damaging remarks in reference check.

You may prepare your defense.
