Employment issue

My friend is working (lower management cadre) in a Birla Company. On account of expensive chemotherapy treatment, he is unwell and taking this poor health opportunity, inhuman / autocrat single boss is rating his performance as "below Expectattion" consecutively for 5 years, while he has performed well in the last 26 years elsewhere in the same company.Hence, no increment & no financial support for treatment as well. He is being asked for resignation; else a forced retrenchment on a/c of poor performance. What are the options available to him : Appeal to Chairman / Legal court-right to life- Art 21 / RTI etc. Please advise.

well if the employee is suffering from the medical problem then the company should accomodate the employee and help the employee in whatever possible manner to support that employee. The employee may approach the HR Department, Management for the help. if they also fail to supposrt the employee, then the employee needs to approach the labour commissioner office for their intervention and immediate help.
