Employment issue

Appointment letter mentions about severance on 3 months' notice from either side & continuance in service subject to medical fitess. However, if someone develops any rarest genetic cancer related disease, which is not on his fault and company does not spend any additional amount on him and disease spreads because of employment hazards (posting in chemical plants), what protection is available to lower management cadre employee in a reputed Birla Group Company. He does not have any hiring & firing authority.Then can he approach Labout Court . Mangement harasses him withholding normal increments over the years citing poor performance after 30 years.Sir,please guide my friend.Urgent legal advice is solicited.Could Country's natural justice help him?

He has to give a complaint in the labour court at where the factory or registered office exists.

If the disease is contracted at workplace due to chemical fumes, employer is liable.

You may look into 'Workmen Compensation Act', ESIC details provided by employer or by nearest ESIC office.
