Epf tax liability that is paid late directly to employee

 

Sir

My previous employer had kept me on contract for 2 years. 

I was confirmed in the 3rd year and regular EPF contribution was started by my previous employer. 

When I left that organization in Apr 2023 I demanded that i be paid or my epf contribution of 2 years before confirmation be deposited with interest in EPFO against my UAN

My previous organization instead of depositing the EPF contribution ( employer employee) share transferred that amount to my bank account. 

The organization did so to avoid paying penalty to EPFO 

Now due to this amount my tax liability has gone up by 30K.

What can i do to somehow reduce this tax liability as this is my EPF arrears that were not deposited by my last organization.

You issue a legal notice to the employer demanding payment of EPF amount.

Let the employer give a reply stating that this is the PF balance, in writing, which will enable you to claim exemption from paying income tax for this amount
