sir 

ESI inspector is conducting inspection in our factory.If he raises any demand for esi payments during inspection, is it mandatory on our part to pay?.is there any way to counter their demand, with our views to the superior athoprities.As this is being the 1st inspection, we don't know what to do.Kindly intimate what is the proceedure in counter the demaund raised by the inspector.Thanking you.

The ESI Inspector or any other authorized officer normally sends advance intimation regarding the inspection of records of a factory or an establishment in his area of operation. On such occasions, the essential records and documents are to be kept ready for inspection and produced on demand before the inspecting authority.

If there are no documents at all to support or documents produced do not support your case, you are running a risk of being served with a claim / notice for contribution on adhoc basis.

 

Right to appeal to Employees’ Insurance Court in case of any disputes.
