Evacuation from the property

Hi

My grandfather own a house which has been built by him and is not a ancestorial property..He has two sons..My father and uncle and has been staying in that house with there respective families since there birth..Now before dying my grandfather has registered the house in my father name and three shops on my uncle name...

Since my uncle, now own those shops and is staying at our home he is not ready to leave the house and is asking money for leaving the house..

Under what sections we can file the case against them so that we can get the possession of our property

1) mutually make settlement Or 2) Go for partition suit since there is no Will executed between ur father n grand father abt house.

I Understand that there is no will but we have the property registred on my father name duly signed by my grand father in the registrar office... Still do we need to go for partition suit or shall we go for specific releif act
