Eviction notice to tenant

My mother an elderly 80 years women wants to move in to her property house where a tenant convert the residential room into commercial warehouse  without her consent and approval.We have served him a legal lawyers notice and he  has not shown any reaction so far. The tanent has been occupy since last 25 years but now we need the room for my mother who does not own any house other then the property inherited from her father.

a tenant is always a tenant if he his staying in your mothers house  for more than  25 years or more also he can be evicted by the suit in the civil court  he cannot get the status of the ownership under law of presciption there is no law in transfer of property that the tenant becomes owner  if he stays for 25 yers or more .

you can file a criminal case against the tenant who has changed the structure of the house without your permission  why you waited for a long time when the tenant converted the room into warehouse without your permission is now a billion dollar question  since your silence amounts fraud  but now you awaked  trry to file  eviction suit in the city civill court  by approach a good advocate who does not collude with the tenant  you can get injuction also  you have not mentioned whether you have given eviction notice or not since before filing eviction suit you should give quit notice to the tenant there are several supremecourt decisions in favour of the owners of the property. You have also not mentioned about any lease agreement between the tenant and the owner of the property

once eviction notice is served you can straight away file a civil suit

I am pleased to hear from you and really appriciate your valuable feed back , I have already served the laywers notice and time to convert back to residential room but there is absolutely no responce or reply, my mother is very soft hearted and we are little kids no body take bold steps other then verbal reminder which obiviously does not work. here is the case as follows:

My mother the land lady wants her own  house to live on the property which has been  converted commercial without her  consent. The  notice was given to evict the room  . she does not have any house under her name How can she evict the tanent who is very evil person.

Please guide we need help

Today my father recieved a call from a person and threating my father to make your reliance payment clear by today only otherwise you need to come tomorrow in Tis Hazari court to settle the case.
 

Being as an educated person i know ths type of call was done by recovery agencies. 

I just want to know is really reliance sue on us for non payment of bill ?
Is ths call was real or fake?
 

Or if i recieved the same call again , what info should i ask from them so that i acn able to check whether call is come from authentic sources or not.

should i ask the case no.?

i have already mentioned that you can file a civil case case for eviction of the tenant  you take  a general power of attorney from you mother for representing the case in the court and to give evidence approach the advocate who has given a notice for eviction to the tenant you also file a criminal case  for coeercision and yusing unparlamentary language against your mother
