Eviction of rented residential flat in mumbai - Tenent since 1956

My Late father was a tenant since 1956  of a residential accomadation and is now occupied by my mother and me his son. The lanlord has filed a case for eviction citing personal requirement. My Mother is 91 years old . On what basis we can retain the tenancy rights. We have no alternative accomodation of our own though my brothers have their own flats. we are living in Mumbai and covered under bombay rent act

The land lord son who has bequeathed the flat from his parents resides in the same building but his flat is smaller than ours.

My Mother is suffering from old age health issues and is suffering from heart and poor eyesight.

I too  is 61 years old retired with no source of income .

On genuine requirement of residence and without any other alternative u can get it.

The Court will consider all the aspects, but no definite suggestion as to outcome is impossible.
