EVIDENCE

According to new amendment now evidence is to be given through affidavit. If some govt. employee lekhpal and police inspector is to be produced as witness on behalf of plaintiff and they do not get ready to sign the affidavit. What may be the remedy. They are very important witnesses.

Official witnesses will not sign the affidavit prepared by us. They can be asked to depose in the witness box. There is no bar for that.

It is better to call such witnesses with documentary evidence they have.

Hi Arvind, fist of all the witnesses u want to summon have to be mentioned in the list of witnesses, than its advised to file an application before the court to summon the aforesaid witnesses alongwith records, if any, and than when they appear in court, get their statements recorded as they are official witnesses .. and thier affidavits are not required
