Ex Parte Divorce

Hi, My wife has filed divorce case against me under sec 13 and sec 125. If i go for an exparte divorce how would it affect me. Or rather how much the alimony amount could be fixed. Already an Interim amount of Rs 2500 pm has been granted to her. My wife left my house on 03/09/2013 & filed for DV in April 2014 and Divorce in Aug 2014. Since 03 Sep 2013 we are staying seperately. I am ready to pay the alimony amount that the court fixes. My monthly salary is Rs 40,000. She has no document to prove this. Also she isn't interested in coming back to my house. So is an ex parte decision good for me and can i challenge the ddecision in a higher court. If so then what would be my marital status. Divorced or Married as i am looking forward to marry again. Thanks Samir Deopujari

If both r intrested on mutual consent divorce, approach the court with clean hands. There is a mathematical calculation for fixing up maintanance to salaried people. However you should engage a well versed lawyer to be more careful to lookafter your welfare.
