In execution petition decree holder gave undertaking in the court (district Judge) that after recieving the possession from tenant (JD) he will hold over half portion of property to his brother who was impleaded under Order ! Rule 10 CPC. But the DH after executing the decree violated the undertaking and diodnt hand over possession to his brother.
what are the remedies available?
(in the civil contempt proceeding initiated at district judge court, the court dismissed the same as being not maintainable before him)
