Exhibit marking in document

  1. In which rule/procedure the marking of document exhibit is described ?
  2. If one document (private letter)is not marked as exhibit still judge relied on that letter whether it is grave error , should in appeal this issue has been raised in high pitch as the trial vitiated and not curable u/s 465 crpc
  3. can some ruling may be provided to support answers

If the court decided a case  relying on a document which was not marked as exhibit, this may be raised as an issue in appeal.
